Seizure upheld following appeal

Amber Athill acted for the Border Force in a contested condemnation hearing concerning the importation of 270,000 capsules of Nitrous Oxide, a psychoactive substance, said to be worth about £810,000 on the open market.

 

The owner of the goods, Elevator Enterprises Ltd, were claiming that the capsules were not liable to forfeiture and that the Border Force had therefore unlawfully seized their goods at Southampton docks.

 

Following trial, the court found that the seizure had been lawful and condemned the goods.
