Employment

BSB Barristers’ Register

Adrian is a specialist in Employment Law and Head of the 12CP Employment Team. He appears regularly in the Employment Tribunal across England and Wales, where he acts for both claimants and respondents.

Adrian’s practice covers all areas of Employment Law. Valued for his personable and forensic approach to cases, Adrian has particular experience in cases involving discrimination and harassment, constructive dismissal, whistleblowing, disability and vulnerable litigants.

He can assist with and advise on all aspects of a claim, from drafting pleadings and preparing (or responding to) complex schedules of loss, to advising on disclosure or settlement agreements. He also has experience of appearing in and advising on judicial mediations, dispute resolution appointments and appeals to the Employment Appeal Tribunal and Court of Appeal.

Adrian’s notable employment cases include:

  • Resisting an employer’s appeal against a finding of indirect religious discrimination (Employment Appeal Tribunal).
  • Acting for the Chief Constable in a highly sensitive multi-day race discrimination and harassment claim brought by a police sergeant, which was dismissed in its entirety by the Tribunal.
  • Advising in several high-value claims involving medical redeployment and ill-health retirement, including in the context of Long COVID.
  • Advising a local authority in a complex disability discrimination claim brought by an employee with a learning disability who also lacked capacity to litigate.
  • Nine-day case involving claims of disability discrimination, unfair dismissal (capability) and loss of pension entitlement under the Local Government Pension Scheme. Case settled after two days of negotiation.
  • Instructed by local authority responding to claims of unfair dismissal, age discrimination and wrongful dismissal being brought by a former Housing Officer. The discrimination claim was withdrawn during the multi-day hearing and the Tribunal ultimately held that the dismissal had been fair.
  • Representing several employees in claims against a restaurant owner, one of whom was awarded nearly £100,000 in compensation when her claims of unfair dismissal, sex discrimination, harassment and post-employment victimisation were upheld.
  • Successful applications for strike out on preliminary issues including time limits, validity of settlement agreements and non-compliance with case management orders.
