Court of Appeal held that avoided held that avoided cost of legitimate disposal of waste constitutes a pecuniary advantage under the Proceeds of Crime Act 2002, even where the waste was originally deposited lawfully.

The appeals of the two appellants were dismissed on that basis.

Syan, instructed by the Environment Agency, prosecuted the case in the Crown Court and was led in the Court of Appeal by Kennedy Talbot QC.
