Court of Appeal. Public Sector Equality Duty. Transgender rights.

An appeal under s.204 Housing Act 1996 was unanimously dismissed by the Court of Appeal. Adrian Peck was led by Kelvin Rutledge QC (of Cornerstone Barristers).

The appeal concerned the duties owed by local authorities to homeless applicants who are transgender and disabled, including the level of inquiry required when determining the suitability of accommodation (with reference both to Part 7 Housing Act 1996 and the Public Sector Equality Duty under s.149 Equality Act 2010).
